On This Date in TWISTED-HISTORY.com in 1893 the Supreme Court ruled that the tomato was a vegetable. The court declared in Nix versus Hedden that even though the tomato was botanically a fruit, it should legally be considered a vegetable. The case came up because at the time there was a tax on imported vegetables but not fruit, leading interested farmers, both native and foreign on having the tomato declared one or the other. The court did refuse to rule on how to pronounce the word.
