On This Date in TWISTED-HISTORY.com! in 1801 Kentucky outlawed dueling. In 1802, the Kentucky legislature had to explain to its citizens that ‘dueling banjos’ wasn’t really dueling and it was still legal to play music. In 1803 the Kentucky legislature had to clarify that when two grown men used banjos to beat each other until one was dead, then that was illegal and no matter what sounds the banjos made as they were slammed against an opponents head or groin, that was not music.
